You needed to have opened a case for an "item not as described" and not just a return request. Sellers can refuse a return request but not the "item not as described" case. Since you already were refused the refund you will need to go to your payment source and ask for a charge back. This will cost the seller an extra fee from eBay and you will win the charge back.
