Chances of INAD case - Bike Frame
Hi everyone,
I have a few days before I can file my INAD case w/ eBay and I was wondering if someone could confirm that I'm doing the right thing for this bike frame purchase.
First of all, the seller did not ship the fork & handlebars that they said they would in the listing description. Honestly I don't need those. My problem is the frame doesn't fit my project. I sent the seller a color coded diagram with the measurement I needed, please see https://i.imgur.com/5uRY2Ix.png. Additionally, I sent them the following message: "ah okay. is it possible to ask for the pink measurement here 400mm or roughly 15.75 in in? If it's greater than 3.8in I'll buy it today". They replied with the following message: "That section measures just about a tenth over 4"." After I purchased the item that same day, the item arrived a few days later and that section measured 2.1in. Much less than 4.1in and therefore I can't use it.
The total for the order was $190. The seller offered me $50 back + the fork and handlebars sent to me. I told them I didn't need the frame anymore and would send it back for a refund of $160 ($190 original - $30 for shipping) and they declined so I'm going to push for a refund.
Do I have a strong INAD case? I can't open a ticket for another few days and he is blaming it on me so I would appreciate some feedback. Thank you!

Mentor4 months agoAny time a buyer files a returns request for Item Not as Described, the seller has to accept the return and pay for return shipping, or issue a full refund and not require return of the item.
