Cannot Appeal?
Hello,
I’m reaching out regarding an order that I believe qualifies for the eBay Money Back Guarantee under “item not as described,” but my original return request has already been closed.
Before purchasing the item, I contacted the seller to confirm sizing. I specifically stated that my hat size is 7 1/4 to 7 3/8, and the seller advised that the M/L size would fit me. Based on that guidance, I proceeded with the purchase.
However, when I received the item, it fits significantly larger than a 7 3/8 and is very loose on me. Additionally, the hat appears to be stretched, which suggests it may not be in the expected condition or may have been previously used—this was not disclosed in the listing.
I submitted a return request, but the seller stated that I would need to pay a $7 fee plus return shipping. Given that the item does not match the description or the sizing guidance provided prior to purchase, I do not believe I should be responsible for these costs.
I have documentation of my conversation with the seller confirming the sizing recommendation and can provide it.
I’m requesting that this case be reviewed under the eBay Money Back Guarantee as “item not as described,” and that I be issued a full refund without being responsible for return shipping or additional fees.
Is this correct?

Mentor5 months agoIf you filed a returns request within 30 days of receipt of the item for Item Not as Described, the seller has to accept the return and pay for return shipping, or issue a full refund and not require return of the item. The seller has 3 days to do either. If the seller does neither, you go back to the case on day 4 or later and click Ask ebay to step in. If you don't do that, ebay closes the case after 21 days.
