Cancellation Request
I purchased an item last night and requested seller to cancel the transaction within a few hours of paying. The seller sent 10 messages harassing me that she is going to sue me, and also referenced my mother and husband's name. How she figured their names out is truly frightening.
One of my questions is if I report the seller for sending threatening and vulgar messages does the seller have the right to refuse issuing me a refund? I understand I can dispute the transaction with my bank, but would prefer to pursue the refund under eBay's money back guarantee.
I fully intend on reporting the seller, as using threating and abusive correspondence violates eBay's policy.
My other question is if I should immediately dispute the transaction with my bank, or just go through the process of initiating a return. I'm not sure which method will refund me quicker, so if anyone has had a similar situation? I'd like to know what your outcome of was. I have been buying/selling on eBay for over 15 years, and never in my life dealt with such a hostile and unreasonable seller.

Reporting the seller for harassing messages does not give them the right to take your money and not delivery the product. They do not have to agree to cancel your purchase, but if she declines, she must ship your purchase.
On this page select violated policy - https://www.ebay.com/help/action?topicid=4022 then select sent threatening messages. In the box describe the messages.
Each message also has a report link under actions.
You should wait until the item is past due, then open a not received claim with eBay. If you go directly to your card issuer, and for some reason they fail to secure your refund, you will have no options - eBay will not let you open a claim once you get your card issuer involved. If eBay can not help, then you go to your card issuer.
After the last expected delivery date, but no more than 30 days after the last expected delivery date, go to your purchase history - select 'I haven't received it' and follow the prompts.
The seller has 3 business days to provide tracking that shows delivery, or a refund. If he doesn't, go to your case and click 'ask us to step in'.
If she does ship, and the item arrives late, you can return it at her expense as late arrival = not as described.
Go to your purchase history - select return this item. Under reason for return, select does not match the description, and follow the prompts.
The seller has 3 business days to send you a return label or a refund. If he doesn't, or says he can not send a label, go to your case and click 'ask us to step in'.
Also be sure to put her on your blocked list - you don't want her buying anything from you in the future for revenge.
