canceling an order 1 hr after purchasing/paying as some unclear condition information came to fore
I ordered and paid for a new, unlocked smartphone today. on the order page, the item was marked 'new'. which is my number 1 requirement. after i purchased, i noticed a page for that item from that seller that did not mention the condition at all. just the brand, spec and that it was unlocked. it seemed strange to me that the order screen show as 'new', but other pages were silent as to the condition. also no returns and covered by e-bay guarantee.this was disconcerting, as i was becoming aware of various phone scams on ebay and after i realized that the seller had been on e-bay for 5 days, had no other items listed. within an hour and 10 minutes, i requested ebay to cancel. this just started smelling very badly to me. i also emailed the seller with my concerns, and advised they might cure my problem if they declared it was in fact 'new'. this hasn't happened after 10 hours. any thoughts on my way forward or what i might expect from e-bay?

Mentor5 months agoBuyers can only REQUEST to cancel. It is up to the seller to file a cancellation, and sellers are not obligated to do so. If seller does not cancel, and ships, and it turns out the item is NOT new, you can file a returns request as follows:
Go to My ebay > Purchase History
Locate the item. Click on RETURN THIS ITEM because it is Not as Described. You will need to click on More to see that option. ebay's Money Back Guarantee trumps the seller's no return policy. The seller will need to provide a prepaid shipping label for its return. ebay sends you a link to print out the label. Print out the label, affix it to the box, and have the counter clerk scan the label. When tracking shows DELIVERED back to the seller, the seller needs to refund you within 2 days. If no refund, go back to the case and click on Ask ebay to step in, to force the refund.
If the seller is from another country, s/he will have to send enough funds to cover return shipping, because the seller cannot provide a shipping label good in this country, or refund in full without having you return the item. If the seller does neither, click on the link to Ask ebay to step in, when it shows up in the case.
