    Buyer stole my item! They replaced the item with something else. Now my item is stolen
                     

    I sold a beautiful, expensive dress to a buyer. She sent pictures of items that are not mine.  And further outlined detail that because I didn't have her inspect the item. Basically, it's ok for her to do this. I can't find any help. She stole my expensive item. This is mail fraud. What do I do?

    Further, because my dress was sold for $600. I also will now be 1099'd and there are tax implications for me. This just keeps getting worse. The sellers need to be just as protected as the buyers. Otherwise, this is just an organized theft ring and a free-for-all for buyers. I certainly hope not and am going to keep the faith that eBay does the right thing in this situation.

    Dear eBay Community Support Team,

    Thank you for reaching out. I truly appreciate your assistance, as this situation has been incredibly upsetting and feels like a violation of trust.

    Here are the details of what happened:

    I sold a high-value designer dress on eBay for $600. The dress was carefully packaged and shipped to the buyer using tracked shipping and label provided by eBay.

    The buyer is now claiming they received a box containing three Armani t-shirts instead of the dress. To what benefit would I gain by doing this? Buyers should be just as protected as sellers.

    Where is the benefit to me by giving her a completely different product? I certainly would never get away with doing something so unlawful. This doesn’t pan out on her end. No one emptied that box and replaced it with something else. This is theft. She did not think this through.

    This is the note from the buyer:

    Note from Buyer:

    This box and it is from XXXXX (confirms it’s my box with photo). I didn't "take delivery" of it, it was left at my address (I would have taken delivery though since it didn't require me to open it and inspect before taking it! I'll contact ebay as well, not sure what's happened here. (she sent me a picture of my box and 3 items I have never owned or have seen in my life)

    This is so unfortunate, it seemed to me like an easy mistake for a seller to have put the wrong item in a box. If this is how you have to make your money there must be something seriously wrong in your lives and I wish you well. I will also report you and handle it legally. Truly, I'm sorry that this must be how you live your life.

     

    Evidence Supporting My Case

    1. Weight Discrepancy:
      • The package I sent matches the weight of the designer dress and its packaging, as confirmed by my receipt from the post office.
      • Three t-shirts would weigh significantly less, which strongly suggests that the buyer is making a false claim.
    2. Buyer Behavior:
      • The buyer initially framed this as a mistake but quickly escalated to accusations and threats to involve their bank. This pattern suggests an attempt to manipulate the situation and may align with fraudulent behavior.
    3. Chain of Custody and Tracking:
      • The package was sent directly from the post office to the buyer. The tracking number confirms delivery to their address without any evidence of tampering during transit.
    4. Legal Considerations:
      • Mail Fraud (18 U.S. Code § 1341): If the buyer falsely claimed to receive different items in an attempt to retain both the dress and a refund, this may constitute mail fraud, a federal offense.
      • Theft by False Pretenses: The buyer’s actions, if proven fraudulent, could also fall under laws regarding theft by deception or false pretenses, depending on state statutes.
      • eBay's Seller Protections: As per eBay’s policies, sellers are not responsible for fraudulent claims if evidence supports the original shipment.

    Request for eBay Action

    To resolve this, I respectfully request the following actions:

    1. Review Shipping Evidence:
      • Compare the weight of the package as recorded in the shipping receipt to the items the buyer claims to have received.
    2. Investigate Buyer’s Account:
      • Check the buyer’s account for any history of similar disputes or fraudulent activity.
    3. Escalate for Fraud Review:
      • Given the evidence, this matter may qualify for investigation under eBay’s fraud and dispute resolution policies.
    4. Legal Rights:
      • I am consulting with an attorney about further actions to protect myself and my rights as a seller. If necessary, I will report this incident to the appropriate authorities for investigation into potential mail fraud.

    Conclusion

    This experience has been deeply upsetting, and I trust that eBay, as a platform, will support sellers like me in cases where the evidence clearly points to fraudulent activity. Please let me know if additional documentation or information is required to assist with your feedback.

    Could you give us more details as to how she stole the dress? Did she open a return request through eBay? If so, did you respond?

    EBay has a 30-day Money Back Guarantee for Buyer Purchase Protection. That Guarantee overrides a Seller's no return policy. If she opened a refund request, even if it was not true, you would need to accept the return and refund.

    If you could give us more information though, we can provide more insight as to how things like this happen.

    I'm very sorry this is happening to you. As mentioned, eBay has a 30-day Money Back Guarantee. This Buyer has 30 days from delivery to open an Item Not as Described refund request and she needs to return the dress.  Nothing more will happen until she does that. She needs to do this on eBay and not through messaging. I would tell her one time to open the return request and then stop communicating with her. 

    Next, I would message eBay on their Facebook page so they can document this and look into her account. We are not able to do that in this forum.  In the meantime, do not refund or offer to refund any amount. 

    Once you communicate with eBay, they will advise your next best steps.  They can read the messages between you and this Buyer. We cannot. The sooner you message eBay on Facebook, the better.

    EBay told use we had to accept her return in order for them to help us. My husband and I both listened and followed what they told us to do. Thank you for your help but there are tons of facebook pages affiliated with ebay. Do you know the link? This is bank fraud, theft by swindle, mail fraud, etc. This is so wrong and ebay has to know how violating and emotional it is to be betrayed and stolen from in this manner. People with higher valued items have been even more violated than me. Some really sad stories are out there. The buyer told me how pathetic I was that I did this for a living and how sad of a person I am. It's psychotic and cruel. What in the world. This can't be something Ebay should be aiding.  Banks should know what is going on too.
