Buyer didnt use my return label and shipped the return to the wrong address.
So a buyer wanted to return as graphics card I sold them. I provided them with a return label through ebay. They never responded back and created their own tracking number. The return never arrived at my door but tracking shows it was delivered. I let ebay know but they still decided to refund the buyer and charged me over $700 dollars to pay the buyer back. This was my first attempt at working things out with the buyer (who has been completely non-responsive to messages) and with ebay (who has stated it was delivered to my address).
So we live in a smallish town and I know our local postmaster. He helped track down the package the buyer sent along with pictures of it in transit. It turns out it was a small bubble wrap mailer 6x4in that weighed less the 8oz. Definitely not a graphics card. And to make matters worse they mailed it to a local CVS address not even under my name or address. So at this point it was obvious fraud.
I contacted ebay and provided them the pictures USPS gave me, including the package with the shipping label, tracking number, name of the shipper and their address along with the name and address it was shipped to. As well as the shipping invoice information. None of which match my address on file with ebay.
I appealled ebay decision to refund me and their response was that the tracking shows it was delivered to my address. Tracking only shows the zip code, town and state it was delivered to right? Not a full address. So how can ebay refuse the appeal and state it was delivered to the correct address when I have USPS saying it was not send to my address?
I have had over four separate conversations and emails with ebay over this and they continue to ignore the pictures USPS provided. Do I take legal action at this point?
