Brand New was in fact Used and Dirty
I ordered an item that was listed as Brand New for $85.00 on March 25, 2025 with the understanding (stated delivery by April 1), that i would receive it by the 1st of April to be used for an event on the 5th. It did not get a tracking number until the 5th and was finally delivered on the 9th. I understand that postal delays sometimes happen ( This was clearly not delayed due to the postal service). However, when I opened the package I found it to not only be USED, but DIRTY as well. The seller does not accept returns. What can I do about this?

If an item arrives but is not as described, then the buyer can file a "not as described" return within thirty days.

If the seller does not provide for tracked return shipping, refund the buyer directly or refund once tracking shows the item has been returned to the seller, after three business days, the buyer can ask eBay to step in.
A seller's "no return" policy only applies to "remorse" returns, not for items that are "not as described".

OP1 year agoThank you so much for this information. I have shopped on ebay since 2009 and have never had an experience like this. I appreciate this.

Mentor1 year agoYou are very welcome!
I have found that most of the sellers that I have dealt with on eBay are very good, but there are always a few that do not measure up, unfortunately.

OP1 year agoI followed the directions in the link to start the return/refund process as "Item not as described". The seller responded as follow: (then offered a partial refund of $0.04 = 4 cents) Should i respond to him/her or just contact ebay again after the date they gave me to try and resolve with seller. Sorry to bother you with this but I genuinely do not know what to do. I know I am not willing to accept 4 cents for being deceived, and that certainly won't cover postage to return it. Please advise.

You must have made a mistake dude. This is exactly what was listed as. Your saying that I listed the item incorrectly

·1 year agoWhen the link appears to be able to escalate the case to eBay, do that. Avoid further discussion with the seller (their response was very unprofessional), and just deal with the eBay case.
