Bought an Iphone on ebay but found out it is not paid off.
I bought a phone that was new in a sealed box. After I opened it, I tried to activate it but later found out that it is not paid off on installments. Isn't this fradulent? What would happened if they stopped making payments? Will ebay support me on getting my money back even thought the package has been opened? I fear to send it back as the seller may refuse refund due to package being opened.

You should open a Return Request. The reason could be "Damaged or Defective Item", OR "Different from what I ordered > Didn't Match Description" if the item you got was not what was shown and described.

Do not close your return request until you either have your refund in hand or you have the replacement item. Do not close it because the seller promises you something.
By doing your return through eBay there is accountability.
Explain the issue in the return case, and then, if the seller returns less than 100%, you can appeal to eBay.
You should get 100% refund.

OP1 year agoThank you so much for the advice. That all makes sense. Its really shameful......its why you have to have a clean title before you buy a car. You can't sell a car that is not paid off. What the heck??
IMHO, I think this goes on all the time, with the many 10s of thousands of iphones on sale on ebay, they really should require the IMEI number and the ESN be checked at the time of listing to confirm that an iphone has not been reported stolen and is not on an installment plan. It would save alot of hassle.
