You have 30 days from date of delivery to file an item not as described refund request on eBay.

4 business days after filing the return request if the seller has not provided a return shipping label OR sent the funds to your PayPal account to pay return shipping if they are in another country then ask eBay to step in and help:

If you have to purchase a label at the post office with the funds that the seller provided be sure to upload the tracking number into the case. The tracking number is your proof of delivery.
Returns to countries that do not have 1st class delivery confirmation MUST be shipped Priority Mail.

OP2 years ago@legend. thanks for your concern. I have had the phone for over 30 days because it was a gift, and I was the gifter.
The recipient was polite not to offend me, but recently told me about it. I spoke with the seller, who hinges his argument on the 30 days return policy.
I have spoken to ebay about this, and they. refuse to see that its false advertising on the part of the seller because it was advertised as unlock.
What will be my best option at this time?

If you paid using PayPal at checkout then you can file a refund request there for up to 180 days from the date of purchase
If you didn't use PayPal then contact your bank or credit about a chargeback for an item that is significantly not as described.
