I feel I'm being penalized for shipping late in order to combine shipping for my buyers.

Yes, there are penalties for shipping outside of your stated handling time as well as for not meeting other metric targets. If it's 5 days, then you must ship within 5 days. Why isn't 5 days enough time for a buyer to complete purchases he'd like to combine for shipping?

If you want to be a top-rated plus seller, you need a one-day handling time and you need to have a 30 day return policy.

If eBay allowed sellers who didn't meet the standards to be considered top-rated or top-rated plus, then those designations would be meaningless, right?

Off topic, but instead of using a flat shipping rate and refunding over-payments on all orders from states close to you, why not use calculated shipping so that eBay displays the correct cost based on the buyer's ship-to zip code? That one change would probably increase your sales.
