Baseless VeRO claim from company who now won't respond - when can I sell my *authentic* item?
I bought an item from a licensed vendor of new sporting goods, a reputable company with over a million sales on here (though I purchased my item from their website). Some unrelated company with an atrocious consumer rating on the web filed a VeRO claim against my item. There are several dozen identical ones for sale. It was a templated listing to which I added item specs from the site I purchased from and from the manufacturer, a well known company, but not one that's counterfeited - ever. I've seen what can be ordered from Ali and the like, and the vendors of counterfeits leave this US company's patented models alone. Nothing was copied & pasted.
The claimant is not a seller of the item, nor the owner or designer, nor a distributor, nor the author of any content in my listing (which I wrote myself), nor the owner of any photos I used. The claim is baseless, but despite my appeal to eBay, I was told I would need to contact "the rights owner." eBay's VeRO team would not tell me which aspect of my listing was identified as an infringement, so I did reach out to the company at the address in the notification accompanying the removal of my item. I drafted my message very closely to examples found in these very forums, written by folks who successfully appealed bogus VeRO claims.
It is now more than 3 weeks since that email. Mind, this item is STILL being sold by over a dozen sellers who use a templated listing, who use the same stock images as one another, and have scant details at best written by the A.I.
I would like to sell my item, but I do not want to run the risk of a second malicious claim on another listing while the first is potentially still open. I have unsealed the previously sealed item, taken all new photos, and drafted the rest; it's ready to go in my Drafts. (FWIW, I still have the original purchase info, the correspondence with the company, even the mailer I received it in.)
Isn't there a window of time that the injured party must operate within? My item is authentic, my appeal is in accordance with the policy, plus the same item is still for sale from others, yet I - a very small fish in this giant ocean of merchants - am waiting on a bad actor who clicked a box.
