Bad Seller Performance
I have a defect that is outside the standard 90-day appeal period, but I believe the defect was incorrectly applied. I had a pre sale item listed and told the buyer it was a pre sale item and they acknowledged that and then filed a claim. I was new to Ebay and did not know you could dispute this. The buyer still has 0 reviews on their account and now I have a bad seller performance. What should i do?

You would not have a defect on your account if you had refunded the buyer within three business days after the case was opened. The buyer would not have been able to open a case unless it was past the estimated delivery date shown on the listing based on your handling time.
You should also understand that for presale items, you must ship within 40 days of listing and that must be reflected in your handling time. The listing should prominently state in the title and description that it is a presale item and state in the description when the item is expected to ship. If you can't ship within 45 days, don't list the item.

There isn't anything you can do about this defect except wait for it to roll off your seller ratings after 12 months.
You have a presale item listed right now with a 2-day handling time. If you sell it today, you will have to ship Monday or Tuesday if you don't update your listing. Otherwise you may earn another defect.

OP2 weeks agoI did not know about the handling time ahead of this. I confirmed with the buyer that it would be shipped at a later date and they were ok with it and never asked for a refund after I said I could.

Not knowing the policies an get you into trouble. It's important to read them and understand them before listing items for sale. You'll find a Help link at the top of every eBay page.
You wrote in your original post that the buyer opened a case. Since you took no action within the case, it sounds like eBay closed it in the buyer's favor.
