APPEAL OF CASE CLOSURE – SIGNIFICANTLY NOT AS DESCRIBED (SNAD) – SELLER MISREPRESENTED PRODUCT FEATU
Subject: APPEAL OF CASE CLOSURE – SIGNIFICANTLY NOT AS DESCRIBED (SNAD) – SELLER MISREPRESENTED PRODUCT FEATURES
To the eBay Appeals Team,
I am writing to formally appeal the closure of my cancellation request regarding eBay Item ID: 227239274452 (Cancel ID: 5439481005).
THE ISSUE:
The seller listed this item as an "Invitrogen Thermo Countess II FL Automated Cell Counter Assay Platform AMQAX1000" . The critical term here is "FL" , which in this product line stands for "Fluorescence" . The seller actively advertised the machine as having this feature.THE EVIDENCE:
Listing Title: The seller wrote "Countess II FL " in the title.
Post-Sale Communication: After the purchase was completed, I specifically asked the seller if the unit had Fluorescence capabilities. The seller admitted that it does NOT.
THE DISCREPANCY:
Actual Product Received / Offered: Countess II (AMQAX1000) – This model is Brightfield only. It cannot use DAPI, GFP, or any fluorescent light cubes .
Product Advertised: Countess II FL – This model is designed specifically for Fluorescence.
WHY THIS IS SNAD (Significantly Not As Described):
The "FL" fluorescence feature is not a minor software setting; it is a hardware-specific optical system that fundamentally changes the value and functionality of the machine. The seller is offering a less valuable, base-model unit while advertising the premium FL version. This is a textbook case of Significantly Not As Described .MY REQUEST:
My cancellation request was denied because the seller claimed it was "remorse," but this is NOT buyer's remorse . I do not want this item because it is missing the critical fluorescence hardware that the seller promised in the listing.I request that eBay reverse the closure of this case and force the seller to accept the cancellation/return for a full refund, including any shipping costs, as this error is entirely the seller's fault.
Attachments available upon request: Screenshots of the listing title showing "FL" and the seller's message admitting the fluorescence feature is missing.

Did you open a Cancellation Request or a Return Request?
If you didn't open a Return Request, you should.
The reason could be "Damaged or Defective Item", "Missing Parts & Pieces" OR "Different from what I ordered > Didn't Match Description" if the item you got was not what was shown and described.
You can open your return request here. Just click the photo and follow the instructions.

Do not close your return request until you either have your refund in hand or you have the replacement item. Do not close it because the seller promises you something.
~~~~~~~~~~~~~~~~~~~
If you already opened a return request and used a 'remorse' reason like 'changed mind' the seller can close those.
In that case, you can file a chargeback on your credit card.
