Appeal a return/refund
I purchased an item on November 27th as a Christmas gift. The estimated delivery should have been Dec 8th-9th. The seller didn't even ship it out until Dec 30th. Since it was purchased as a Christmas gift, I Now, No Longer need it. I want to return it and get refunded. The seller is refusing and Ebay won't make this situation right. I've had an Ebay account for many years. I've spent a lot of money on this site. If Ebay can't make their sellers do right by their customers, I won't purchase from them again. They will steal my money again.

Late delivery makes the item not as described. A seller cannot refuse a not as described return unless he just refunds your payment without requiring return.
Go to your purchase history - select return this item. Under reasons select does not match the description, and follow the prompts. In the comments note arrived 4 weeks after estimated delivery date.
The seller has 3 business days to send you a return label or a refund. If he doesn't, or says he cannot send a label, go to your case and click 'ask us to step in'.
