An item I bought does not work
Greetings,
I purchased a tape deck on ebay that was listed as "working great and fully functional." Pictures of the item on the listing showed it to be in great physical condition.
When I unpacked the deck, one of its feet was broken and a corner of its cabinet was crushed. Also, the deck is non functional.
The seller is saying it had to be damaged in shipment because the deck was working perfectly and undamaged when he shipped it. He said he would offer a partial refund, then decided to check with Fed Ex about a full refund. He said it was insured for the full purchase price.
I received the deck on Feb 27th. I messaged the seller on the evening of Feb 28th. I did not hear from him yesterday about his decision on the refund.
It has only been one day since I messaged the seller, but my question is, how much time do I have as a buyer to wait on him to contact me regarding what he wants to do to refund the purchase price of the deck? I do not want to wait too long, to the point that the returns process will no longer help me, if the seller is slow to refund the purchase price, or eventually, says he won't refund the purchase price.
I may be doing this all wrong by waiting on him. The ball may be in my court and I should be the one pursuing the return instead of waiting to see what he decides to do.
