Am I being scammed?
Summary: pau1597 shared their difficulty with attempting to purchase a Home Depot R2-D2 on eBay, where the seller claimed they accidentally sold the item locally and promised to cancel the order. However, despite their communication, the cancellation hasn't occurred, leaving pau1597 without their money. They expressed concerns about being scammed and sought advice. lady_madonna provided a detailed process to request a refund through eBay, while krazzykats suggested putting their name on a waitlist for restock notifications or checking local stores for availability.
I recently attempted a second purchase of the Home Depot R2-D2. The first one fell through and it took a few days and I got my cash back. This second attempt, I was contacted by the seller through eBay mail shortly after making the purchase and got this message:
"I’m sorry I sold this locally and forgot to remove it from here. I’ll cancel the order"
To which I responded please do, I'm not a millionaire and to make another attempt I really need my cash back. It's been three days since I sent that response and have no record or indication that the sale was canceled on the sellers end and I really need the cash back to try again. Should I cancel the order? I've done nothing but wait for the seller to do what he said he was going to do and cancel it from his end.
I'm not super experienced ebayer. I tried to get help through eBay and it says that I must wait until the 5th and if nothing received, I can start the process myself. I made the purchase on Sept 30 and it was on Sept 30 that the seller emailed me and said said he'd cancel the sale, that he already sold the item and forgot to take the listing down.
Am I being scammed?
Thanks for any guidance.

Mentor5 days agoPut your name on the Home Depot email for when the item is back in stock. You could also ask at your local store if they expect more in.

Mentor5 days agoIf the seller has not cancelled the transaction, you will have to wait until the latest estimated date of delivery has passed by at least 1 day then file a Refund Request due to item not received.
Go to your My Ebay page >> Purchase history
· Select “More actions” beside your item and then “I didn't receive it.”
· Click the box beside I want a refund.
· Select Send request.
If the seller does not respond to the refund request, after 3 business days you can ask Ebay to step in to help you.
· Find the item in your Purchase History
· Select See request details
· Select “Ask eBay to step in.”

OP3 days agoIt looks like the charge never hit my bank even though on my end it says paid and I still see no cancellation on his end. It was supposed to be here between October 1st and 5th. Tomorrow is the 5th. What happens if I cancel the sale on my end ? Unless it's suddenly back in stock and it's shipped/delivered tomorrow, (there is no tracking information available under item detail) has time not expired? Sorry for the questions, I've always had a pretty good experience with eBay, until now. Thank you for your time/perspective and helping me to understand.
