If you are needing to file a Refund Request due to item not received, you must wait until the latest estimated date of delivery has passed by at least 1 day.

Never let a seller stall you.
If the latest estimated date of delivery was Oct. 15th, you should be able to file the Refund Request on Oct. 17th.
Go to your My Ebay page >> Purchase history
If the seller does not respond after 3 days, you can ask Ebay to step in to help you.
