A seller who scammed me for my item
A person who scammed me from my item n he's refusing n he basically denied my return so now I'm stuck with a defective item

If you had specified that they item was defective, there was no way the seller could decline your Return Request because the Ebay Money Back Guarantee overrides a seller's "No returns" policy.
Perhaps there are more pertinent details you can share?
