A Seller that won't communicate
I have been trying to get my money back, I have purchased an item that has nothing sent yet, I have been trying to communicate several times to the seller and he will not respond, now I don't need it and I want my money back since I purchased it elsewhere. How many days I have to wait this is ridiculous

How long ago did you make the purchase, and what was the last estimated delivery date when you made it? If you go to your purchase history and click on the Order Details button you will see the last estimated delivery date.
If that date has passed by one day and there is no tracking info showing that the shipping agency has received the item, then you can open an Item Not Received (INR) dispute. To do that go back to the purchase history click on the More actions button, first select Return item button which opens a menu of reasons for a return, and choose I haven't received it. Follow up to file the dispute, which will appear on your My ebay page. The seller will have 3 days to respond by either providing tracking showing they have shipped the item or to issue a full refund. If they do neither or make excuses on the fourth day open the dispute and click on the Ask ebay to step in button, and a full refund from the seller's account will be issued.

Did you check the seller's feedback profile page before buying from them? If not you should do that now. You want to look for two things on that page, the seller's country of registry and their feedback as a seller. If the seller is located in a foreign country and there is a domestic service's tracking number, it may have been shipped, but hasn't reached the U.S. cleared customs and been handed off to the domestic service.
If your seller has not received an feedback for selling before or in the last year, they may have run into eBay's 30 day hold on their first few payments, and did not know about it or how to deal with it. The seller could have a fair number of feedback and even a 100% rating, but all for buying in at least the last year. In that case they probably ran into ebay's 30 hold on new/returning sellers first few payments.

Really sorry that happened ... the date you want to keep an eye on is the original estimated delivery date. One day past that is when you can process a claim.
You are protected by the eBay Money Back Guarantee for 30 days from the latest estimated delivery date: eBay Money Back Guarantee policy
You can file a claim via the item in your Purchase History that you did not receive your item one day past the original estimated delivery date and up to 30 days after that. Follow the steps in the claim and they will lead to an eventual refund.
