A seller knowingly sold me a phone that has been completely misrepresented
And cannot be used. At first he was in contact with me, but everything he said, turned out to be lies. As of yesterday he stopped communicating. I do not want to try to communicate with him anymore or to send him this phone because I think it well, and up with the phone disappearing And my money and the phone will be gone. I think he got sold a bad phone and he was trying to recoup his loss by selling me a bad phone. This is too complicated to try. Explain on a computer how can I accomplish this on eBay? Is there someone that I can talk to? The phone has been completely misrepresented.

OP3 years agoThank you again. This is all a little bit confusing and overwhelming to me but I appreciate the information and I’m sure that it will somehow work itself out in the long run.

The return process is quite simple. Within 30 days of receipt of the phone, go to your purchase history and open a return, selecting the reason "does not match description or photos" or the reason "item is defective". Add a photo of what you received and describe the problem. The seller will have three days to send a return label. When tracking shows the item has reached its destination, the seller has only a few days to issue the refund. If the sellers fails to do so, you can click the button within the claim to ask eBay to step in to force the refund.

OP3 years agoThank you for the information. Since I feel he has deceived me all the way around I am really not feeling comfortable about sending him the phone. If I send it by special delivery or required signature or something like that it is going to require extra cost. Is it acceptable to expect him to pay for the cost to send it back and at what point would I request that? He charged me $17.50 to send it to me which I’m pretty sure I can kiss goodbye but I wasn’t expecting to have to send that back. Thank you again for your help.

The seller is required to bear the shipping cost for this type of return. When the seller agrees to the formal return request, eBay typically issues the return label, and will charge the seller for that label. If the seller does not respond within 3 business days of opening the return request, an option will appear to ask eBay staff to step in. Up to that point, all stages were handled by the system. eBay staff will then force the issue.
The person responsible for the return label (the seller, in this instance) may want to add insurance in case of carrier loss. Package the item securely to avoid damage. The return label carries a tracking number. Be sure to get it scanned when you hand it to the carrier.
As soon as tracking shows delivery, your part is done. The system will allow the seller a couple of days to inspect the returned item for damage and will then instruct the seller to refund. If the seller does not respond within 2 business days, you can ask eBay to step in. Refunds appear 3-5 days thereafter. The refund will cover item cost, initial shipping, and sales tax.
