2nd Hand Laptop purchase Dispute - Am I unreasonable?
I bought a 2nd hand Dell laptop on Ebay for £860. One year old. RRP was £2500.
I would of course expect some wear and tear on a used item but it was described as 'Like new'.
I bought it for the 4k screen but it turns out the most obvious fault was that it had a faulty, blotchy screen.
The screen issue was not hilighted in the auction. When I complained to the buyer he said there are no refunds or returns and criticised me for bidding at the last minute and then changing my mind.
He also mentioned I shouldn't be expecting a new item when its clearly 2nd hand despite the fact he used the words 'like new' in the auction description.
Am I being unreasonable opening a dispute over this?

Not a bit of it. If it were me, I would open a Not As Described dispute today. Obviously, by saying "like new" the seller lied about the description, because it is not like new – or, to be charitable, let's say he "hyped" the description – to make it sound more desirable than it deserved.

OP2 years agoThankyou for your response. The seller is still arguing that I'm being unreasonable expecting a 2nd hand item to be new. Which I'm clearly not.

It takes two to argue. Stop arguing. Just open a Not As Described. The seller knows that he wasn't exactly truthful with the description. He's mad because he got caught. You know you're right; you didn't expect new, but you did expect "like new" ... his words not yours.

OP2 years agoThanks for the words of wisdom. I have one final concern, and that's being slapped with negative feedback. I once left Neutral feedback for a Seller and he was so mad, he left me a negative. This was back when it wasn't possible to request feedback to be removed. If I am left Negative feedback, am I right in thinking I can now reasonably ask Ebay for it to be removed?

Mentor2 years agoHi @dunx Even in the UK it is impossible for sellers to leave their buyers negative feedback. It was changed quite some time ago because of the kind of retaliation you experienced from a bad seller. If the seller were to leave a green positive mark with a negative comment, you could just contact eBay customer service and they would remove it.
I second what @gosimus advised to stop arguing with the seller. It's pointless. All you need to do is open a Return for Not As Described and the seller will have to take it back. DO NOT use any other reason other than that "Your item didn't match the listing, or it arrived faulty or damaged." You will need to upload a photo. The seller will have to pay return shipping, so don't let them fool you into paying it. It doesn't matter what the seller's return policy is. eBay has it's own return policy which is that you can't rip off its customers. The seller must send you a pre-paid return label. If they do not, after 3 days from filing the Return, the Ask eBay to Step In option will appear. Ask eBay to step in and eBay will take it from there. If the seller still wants to argue, eBay will deal with them. File for a Return and pay attention to the deadlines of what you must do and when. When you send it back, package it well. The seller is paying for the postage, not you. Good luck!
