eBay will not be legally required to send you and the IRS a Form 1099-K for your eBay sales during 2026 until/unless you meet both criteria:
1. Minimum number of dollars of gross earnings: $20,000 AND
2. Minimum number of transactions: 200.
(If you live in a state with lower required minimum gross earnings and transaction quantity, eBay will issue you a Form 1099-K when you meet those state criteria.)
These truths remain:
In general, the IRS expects all of us to report all of our earnings when we complete our Form 1040 (or applicable version) tax return forms. With or without a Form 1099-K. Period. If eBay does not send you a Form 1099-K, that does not mean that your earnings from eBay are not taxable as income.
