The federal (Internal Revenue Service) criteria for issuance of Form 1099-K are twofold:
1---Number of dollars of gross earnings: $20,000.00 AND
2--Number of transactions: 200.
BOTH of those thresholds must be met before eBay is required to issue Form 1099-K to the IRS and to you.
This means that if you have eBay gross earnings of -- let's go a little wild here -- $10 million dollars but "ONLY" 199 separate eBay transactions, eBay is not required to issue Form 1099-K to the IRS or to you.
The IRS expects YOU (and all income tax payers) to report all your earnings, including your eBay earnings, on your federal income tax return, form 1040, regardless of whether eBay sends you a Form 1099-K or not.
BTW, a quick google search tells me that the State of New York follows the federal threshold guidelines for Form 1099-K. You're welcome.
If you meet the dollar amount and number of transactions then you will receive a 1099K form. Your state may have a lower limit to receive one, you would need to check with them.
You are required to declare all income on your taxes regardless if you receive a 1099K or not.
