recently eBay without telling me sent one of my items out of USA, there were conversations with the buyer. I had no idea they were not in USA, then the buyer scammed a return and now I am being penalized by eBay, is there anyway to deny eBay global shipping of my items, especially without my consent

How did the buyer scam you? If your items are shipped with international shipping and the buyer files a claim, eBay deals with any returns or items not received so you shouldn’t have been affected, could you give more details please.
If you don’t want to use EIS you can block all other countries in your shipping preferences but before you do that you might want to find out more about EIS as it does benefit sellers.

You must have had some idea of what you were doing with your international shipping. Some of your items have restrictions, some don't...that takes human intervention....
For your problem at hand, the recommendation by @pjcdn2005 to "Opt Out" is the easiest way to accomplish your request. Right at the top.
also, if your item was shipped via EIS, you 'should' be covered by ebay
(Putting the USA Buyers Only in your title does nothing except to maybe provoke foreign buyers (o;....)

However, there IS a way for a customer to get around this: They use a Freight Forwarder.
Was the shipping address IN the United States? Delaware, Florida, Oregon... common addresses that a Freight Forwarders. I have shipped hundreds of purchases through Freight Forwarders without issue. Why? I believe your correct. The address was probably a freight forwarder in the U.S.
The seller failed to do their homework on the buyer.
1. View buyer's profile. It will tell you where the buyer is actually located.
2. review all feedback categories of the buyer.
3. Google map / satellite the shipping address.

In my experience, shipping to a freight forwarder is no more likely to lead to a transaction gone bad than shipping to any other address in the USA.

It can if you don't do your homework on the buyer first.
There are many great international buyers that use U.S. freight forwarders. They are normally serious buyers. Their complete profile should show that.
My understanding is that if you want eBay seller protection for international sales, you opt into that service. Otherwise, a seller should to their homework and calculate risk of not using eBay international shipping.
