Ebay Robs me!!!

Sold item on dec 16th

buyer complained and got his money

back because of ebays magnificant

money back !!!

 

Since then im trying to get my item back

now since 4 months and 229 euro lost

on the item ex shipping to spain!!

 

Mailed the buyer almost 40 times

complained to ebay a dozen times

they dont care

 

so i will start a lawsuit !!! 

so sad that this happens!!

 

almost every day since i try to contact

them , located in europe and the

local help desks wave it away!!!

 

anyone got the same "issue""???

You sold an item on Dec 16.

They buyer Claimed a refund.

What was their reason?

If it was Item Not Received, did you supply the tracking number?
If it was Not As Described, did you supply return shipping?
If you did neither, the buyer would be refunded.

 

Note that even with a No Returns policy, you can demand the return of the item before refunding.

A No Returns policy is not a No Refunds policy.

 

Did you use eIS shipping which is a Seller Protection program ? Or did you ship directly?

If the buyer got a refund before returning the item, you did something wrong.

The OP is in the Netherlands and I think the item was shipped to Spain.

@flipdiorama  eBay did not rob you, you allowed it to happen because you do not understand the MBG policy. Please read up on this, pretty sure it is the same for all eBay sites.

When a buyer files a Item Not As Described type return case, IF you want the item back before refunding,  a seller has to accept the return and provide a prepaid return label or the money to purchase a return label. 

 

The buyer then sends the item back to the seller.

 

When you receive the item back, then you refund.

 

Never allow eBay to refund in your behalf or you lose the item and the money.

Yes he received the item and there was a 1 mm scratch on the front window , so i said return it !! thats it but he never did!!

ebay checked if the buyer sent it back

even didnt bother , 

 

but looks like none of below gives

a good answer or would help me

The ONLY time that happens is in a couple of very specific situations.

 

If the buyer opened a Chargeback Dispute which is filed directly with their Financial institute and NOT in an Ebay claim.  Then the outcome is in the total control of the Financial institute and Ebay can only do what they say.

 

The other is if the buyer opened a REquest for Return in Ebay and you tried to battle it or deny it.  Three days or more passed and you didn't accept the return request, so your buyer asked Ebay to step in.  And since you have a No Return Policy on your listings, Ebay would not require the buyer to return the item, because your policy says you don't take returns, but your buyer would get refunded at your expense.

 

Don't get rude with those that are trying to help you.  You have provided very limited information for us to work with, so don't get upset with us because you may not like or agree with what we are saying.

im afraid that no one has!!

Sounds like the buyer filed an INAD and you failed to accept the return or pay return shipping.

When that happens, Ebay can step in and refund the buyer from your account and let them keep the item.

If the buyer filed a dispute and you allowed eBay to step in and decide the case, then according to the eBay user agreement you agreed to let the buyer keep the item in the even the buyer won the dispute. 

 

so i will start a lawsuit!

Please come back and let us know how that turns out. But I would be surprised if a court allows you to break your agreement with eBay.
