I purchased an item, the condition of which was mispresented. Seller does not accept returns and refused to do so when I called her attention to the condition of the item. In fact she described her extensive efforts to clean the bowl (sterling silver) prior to listing it which of course she did not disclose. Had she done so it would have been clear that the spots within the bowl are permanent. Because she does not accept returns I cannot even get Ebay to intervene. Furthermore, Ebay no longer will talk to its buyers and sellers on the telephone but rather refers you to incorrect or irrelevant articles.

Unless listed in a category that does not afford buyer protection, or the buyer chooses the wrong return reason, the eBay MBG overrides a seller's "does not accept returns".
A "no returns" policy is for "remorse" reasons.

@hofl It doesn't matter what the seller's individual policy is if your item wasn't as described. You can start a return case with as not described as the reason and the seller will be forced to pay return shipping, obviously you should only go down this road if your item truly wasn't as described.

Have you tried the MBG?
Go to your purchase history and click return item and select, the item doesn't match the description as the reason.
The seller will have 3 days to accept the return and pay return shipping or refund without returning.
If they don't, return to the case on day 4 and ask Ebay to step in.

Hi @hofl
You absolutely are entitled to a full refund ... with the seller paying the return shipping. All you need to do is file a 'return request' from your Purchase History ... choosing 'Doesn't match description or photos' as the reason for the request.
Talking to Customer Service isn't necessary. If the seller doesn't provide either a prepaid shipping label OR a full refunds within 3 business days after you've opened the return request ... then you just have to go back to your open request and ask eBay to step in. eBay will handle the rest.

As a seller yourself, I'm surprised that you aren't aware that misrepresented items can be returned whether a seller accepts returns or not.
GO to the order and in the dropdown box, click to "return this item." When checking the reason, choose one of the NAD (not as described) options. Seller will have 3 days to either respond with a return shipping label (at their expense) or to issue a refund without requiring a return.
If they don't respond within the timeframe, you can go back to the claim and ask ebay to step in. they will either issue the refund (allowing you to keep the item) or they'll send a shipping label paid for by the seller. Once returned, you'll get your refund.
