buyer hasn't paid or contacted me or ebay  for 4-5 days,  opened case,  no contact for 3 days,       saw   2nd chance offer on the item,  so i reposted it to that specific  bidder that lost the auction and offered it to him,   he jumped at it and paid,      and my question is,  why  would ebay offer 2nd chance offer availability if a case is open.????

You should not have sent the second chance offer until the Unpaid Item dispute was closed. What will you do if the original buyer pays? The second chance offer is there for you to use, but eBay expects you to know when to use it.
