I've had no email confirmation yet from ebay saying they are looking into the report. All they had was a general statement at the end saying I would hear very little from them.
The buyer used a tracking number and is asking me when I am refunding their money since I recieved the item.
Do I email the buyer about the damage, what do I say?

My advice is to refund the seller his purchase price + original shipping. Otherwise he will probably give you negative feedback and low DSRs. I am not saying that you are right or wrong, or that this is fair or unfair. I am only saying that you should make your buyer happy. Then you can add this buyer to your blocked bidders list.
