Shipping back defective item

I recieved an item that was not as described, it was defective and well used. The item descrition and reply from seller said it was used once. Item shows a huge amount or use and is no longer able to be used. I have recieved a refund thru ebay but have not been asked to return the item. The shipping charges are more than the item is worth. Do I throw it away, or does the seller have to pay for shipping. The item was pictured as new and some of the parts were not included so they cannot be returned.
