Payment on Hold...waiting for a return..

Can someone help me out.

A customer requested to reutnr a phone he purchased from me.  The return was request on Sept 3rd.  Ebay says:

"We've asked the buyer to ship the item back by Sep 21. Wait until you get the item back before issuing a refund."

It is now October 3rd still do not have the phone and my money is still being held.  When is this going to be relased and when is this case going to be closed.  Its been a month he still has the phone and has not returned it and my money is now behing held
