How can I cancel a sale that has a case open on it?

Although I click on close case, and there is a message saying that it was closed on a certain date, it remains opened and therefore uncancelable. Can I cancel this buyer's sale on my end? He is too new to ebay and doesn't reponsd to the case on his end. I'm trying to avoid him getting a non-paying bidder striker since he requested a cancel, but did so after the case was automatically open (of course). (I set mine to 4 days.)
