How can I get e-bay to take down a sellers item? Someone is trying to sell a photo claiming it is my bother when is is clearly not.

I wouldn't care if the photo was of my brother, but the fact that he was 10 years old in 1969 CLEARLY makes it not him.  So to me it is fraud and should be taken down or at least re-listed with different info.

You might try to message the seller and suggest they do a google search for an authentic picture, but other than that not much you can do.

it seems that the photo is an old press photo...don't know whether or not that puts it in the public domain, or if the original publisher owns the rights to it.

 

I doubt very much that ebay will remove it just because you are related to the subject in the photo.

 

if you are that bothered by it being listed, you may want to contact an attorney.

A photo of your brother?

 

ONLY the rights owner can register as a VERO member - and then report to ebay that listing - and ebay will take the listing down.

 

Anyone else complaining about it - means nothing.
