The buyer did not pay, so I opened a cancel the transaction case. He declined to cancel it and said he would pay but never did. Now he is not communicating and I want to open an unpaid item case but ebay keeps telling me the case is closed and to work it out. What are my options to get my final value credit fee back?

You have no options. When a buyer doesn't pay, the appropriate case to open is an unpaid item case.
Just curious about why you attempted to cancel the transaction instead of opening the unpaid item case...
