case was opened as item not as described but closed when partial refund was made. When item was used on xmas day it was found to be defective. seller states it is not their problem but as I already reported item I cannot open dispute. I cannot find link on site to contact ebay but a telephone number in America. Anyone help please

To reiterate, eBay WILL NOT become involved at this point because you have already filed, and closed, a dispute.... the 45 days is irrelevant.

No, there is no reopening a closed case and you cannot file a new one on the same item. Calling will not change that.

You can't -- once a case is closed it can not be reopened
if you are within your 45days of buyers protection you should be able to return it for a the rest of your money - if you are over the 45days Ebay will not become involved
