SELLER BEWARE: No returns accepted means returns accepted!

Ebay is a complete joke.

I had an auction that clearly stated no returns accepted. The buyer opened a case and eBay decided it in his favor. I called them and asked how the buyer could possibly win the case when it says no returns accepted and they basically told me they side on the buyers most of the time. He told me that no returns accepted basically means nothing at all.

After reading what you just said, it was like something just snapped in my head.  I have read countless of eBay's rules and regulations and of their twisting those rules.  Just as they have "TERMS and CONDITIONS", we as sellers (who by the way are the owners of the products we sell, NOT eBay) have every right to enforce our own "TERMS and CONDITIONS" as long as we do not blatantly do anything that is listed as VIOLATION of eBays Terms.  The "priveledge"to use their site is taken care of by paying the fees they charge us.  That should be it.  As long as we do not actually violate any rule, how is it that they legally can in turn force a seller to give up any sale monies because they are violating a Term and Condition stated as ours.  We should have a legal stance here.  If we are in business, how can they ourtight violate our terms and conditions? I don't care how big or powerful a business or company is, a business is a business is a business.  Just because we are a small or part time business and use their website to sell, (which we PAY to use), then a NO RETURNS should mean NO RETURNS.  Thank you for letting me vent!

unfortunately angel it does not work that way on ebay, it is their site, so their policies trump anything you write on your listings. so the best you can do is just copy their policies into your listings because that is what counts.
i have seen a lot of sellers with huge Terms in their listings and i just chuckle because i know none of that means a thing, only ebays policies count.

Such a pitiful state of affairs..... I am totally aware of what you said adf07bid, I was just venting and being the "Devil's Advocate". It's nice to shake your fist up in the sky with outrage. Good therapy LOL!

I don't think the buyer automatically gets to keep the item. It depends on how the seller answers the case.

Because you signed a contract with eBay when you registered, stating that eBay's Terms and Conditions must be followed, including the Buyer Protection Policy.  Thus, your legal stance is to fulfill your part of the contract, should a BP case be filed.

 

 

As to the retail store vs. eBay posts, there is a huge difference between buying in a store and buying online.

 

In a retail store, the buyer gets to inspect the item before purchase.

Online, buyers are buying sight unseen.

 

Because of this difference, a store can have any return policy allowed by law and the contracts they have signed with their payment processors, including stating "All sales final.  No returns."  Since the buyer can inspect the item before purchase, those policies can be enforced, and the payment processing companies will back the store.

 

On eBay, or really anywhere else online (due to credit card contracts), a no returns policy cannot be enforced, since there is no inspection prior to purchase.

But they will gladly give REFUNDS......at your expense.....
whether you accept returns or not !

Just so all of you know - when you read the UPDATED EBAY POLICIES (Oct.26 in EFFECT) or Written Sept 11 (Today for new ebayers):

 

FYI

 

In addition, we updated the policy to reflect that, if as a seller, you choose not to engage with the eBay Buyer Protection process on an item not as described case, we may seek to carry out a reimbursement from you without asking the buyer to return the item to you.

 

So it is important to read what you sign a contact to sell on their website!~

eBay says buyer can return any item they claim SNAD for 45 days.

Seems sellers terms and conditions are trashed trumped by eBay's, no?


The definition of insanity is doing the same thing over and over again and expecting a different result.

I hate the direction Ebay is taking! It's Socialist in my view. First time they overule my terms I gone!!!

 

I'm a sellar that is cleaning out my gargage of old 60, 70, 80's Corvette and Hobie parts. One could say "one mans trash is another treasure". Where else are you going to go for a 1967 Corvette stearing column??? They are not reproduced or available from GM.

 

Guess I'll have to go back to doing Sway Meets on Sundays or use other sites.

 

 

The thrill is gone.

It's out rages a buyer has that long to return and item. Even in stores you only have 30 days for a purchase and in some cases only two weeks. Example: I purchased a 1600.00 riding tractor return policy is only 2 weeks from Sears. Sellers need to be awear that even if you don't have a return policy and you do accept the return your Pay Pal account is put on hold for those funds. To make things worst if it was several items a buyer purchased and Ebay treated it as one transaction even if it was seperate item numbers and shipped seperate but they paid for all the items at one time it's one tranaction and Pay Pal will hold the entire amount for the transaction instead of the dollar amount for the one item being returned. DAH

Ebay is definitely not for the sellers. I sold a cell phone in perfectly good condition and the buyer claims it doesn't work because he lost emails. That has nothing to do with the phone itself but I know what's going to happen. I either refund the purchase price plus shipping and still have to pay the return shipping or refund most of the money and let him keep the phone. I'm really beginning to hate Ebay.

Ebay is not for sellers, they easily overules your 'NO RETUN', 'FINAL SALE' terms, they will listen even to the most negligent buyer making crazy demands and take the money from your account, even make you pay for the return shipping!! this situation sucks!!!

I absolutely agree. The selling experience with ebay can be a living nightmare. Never again, will I sell. No returns means absolutely nothing to ebay. It seems that no matter how ridiculous the claim is , ebay takes the side of the buyer. It is a horrible experience.
